David M. Birka-White

In 2007, 2008, 2008, and 2010, David Birka-White was selected as a “Super Lawyer” in the San Francisco Magazine’s edition listing the top attorneys of Northern California, as selected by their peers. Mr. Birka-White has been AV-rated for over 20 years, the highest rating by Martindale-Hubble, the nationally recognized authoritative resource for information on the worldwide legal profession. He is recognized for high professional legal standards and ethics and is included in The Bar Register of Preeminent Lawyers published by Martindale-Hubbell.
Mr. Birka-White specializes in product liability and consumer fraud. He has handled dozens of significant product liability cases and class actions involving defective products. Mr. Birka-White was among the first attorneys to successfully prosecute nationwide class actions involving defective building products. In the last ten years he has served as lead or co-lead council in cases in which the settlements exceeded
$400 million while assisting thousands of individuals.
Mr. Birka-White is a contributing author to California Class Actions Practice and Procedure, (Elizabeth J. Cabraser, Editor in Chief, 2003).

Mr. Birka-White has served as Legal and Technical Advisor to California State Senator Nicholas Petris, who authored Senate Bill 1873. The bill, signed into law as Health and Safety Code Section 17921.7 imposes penalties for the sale or use of sub-standard plastic in ABS plastic pipe. The legislation came a as result of the ABS pipe litigation initiated and prosecuted by Mr. Birka-White.
Mr. Birka-White is a long standing member of The American Association for Justice (AAJ) (formerly known as the Association of Trial Lawyers of America) and The Consumer Attorneys of California (CAOC). He has served on the Board of Directors for CAOC and on the Board of Governors for the Alameda Contra Costa Trial Lawyers Association.
Mr. Birka-White has spoken at numerous seminars involving product failures and building product class actions. He has spoken at the Annual Convention of Forum, the construction section of the American Bar Association, on the subject of building product class actions.
